TERMS AND CONDITIONS OF SALE
1.1 Acceptance of the Terms
By accessing the Website, creating an account, placing an order or purchasing a product, you confirm that you have read and accepted these Terms and Conditions, our Shipping and Delivery Policy, Return, Exchange and Refund Policy, Privacy Policy and Cookie Policy.
Nothing in these policies limits any mandatory consumer right available under the laws of the United Arab Emirates.
1.2 Eligibility
You must be at least 18 years old and legally capable of entering into a binding contract to place an order. A person under 18 may use the Website or place an order only with the involvement and approval of a parent or legal guardian.
1.3 Product Information
We take reasonable care to ensure that product descriptions, photographs, sizes, fabrics, colours, country of origin, care instructions and prices are accurate.
Colours may appear slightly different depending on the screen, device, lighting and photography. Measurements may vary slightly because of the design, material and manufacturing process. These reasonable variations do not constitute a defect unless the product materially differs from its published description.
Customers are responsible for reviewing the product description, size guide, material information and care instructions before ordering.
1.4 Product Availability
All products are subject to availability. Adding a product to the shopping cart does not reserve it.
If a product becomes unavailable after an order has been submitted, we will notify you and refund the amount paid for the unavailable product. Where appropriate, we may offer a replacement product, but no replacement will be sent without your approval.
1.5 Prices, Taxes and Charges
Unless otherwise stated:
a. Prices displayed for customers in the UAE are shown in UAE dirhams (AED).
b. Applicable VAT will be included or displayed as required by UAE law.
c. Shipping charges, payment-related service charges, customs charges or other applicable costs will be clearly shown before the order is completed.
d. For international orders, import duties, customs clearance charges and local taxes may be payable by the recipient unless the checkout expressly states that such charges are included.
We will not charge an amount higher than the amount displayed and accepted at checkout, except where an additional service is separately requested and approved by the customer.
1.6 Orders and Contract Formation
Submitting an order constitutes an offer to purchase the selected products.
After submission, you will receive an electronic order confirmation. This confirmation acknowledges receipt of the order but does not necessarily constitute final acceptance.
The order is accepted when we send a dispatch confirmation or otherwise expressly confirm acceptance. We may reject or cancel an order before dispatch where:
a. the product is unavailable;
b. there is an obvious pricing, description or technical error;
c. payment has not been authorised;
d. fraud or unauthorised activity is reasonably suspected;
e. the delivery address is incomplete or outside our service area; or
f. fulfilling the order would violate applicable law.
If we cancel a paid order, the amount collected for the cancelled products will be refunded to the original payment method.
1.7 Digital Invoices
A digital invoice or purchase record will be provided electronically. Customers should retain their order confirmation and invoice for returns, exchanges, warranty claims and other enquiries.
1.8 Payment
Available payment methods will be displayed at checkout and may include credit cards, debit cards, digital wallets or other approved payment services.
Payment information is processed through authorised payment providers. We do not normally store complete payment-card numbers.
You confirm that:
a. the payment information supplied is accurate;
b. you are authorised to use the selected payment method; and
c. sufficient funds or credit are available.
An order may be placed on hold or cancelled if payment cannot be verified.
1.9 Promotions and Discount Codes
Promotional codes:
a. must be used before their expiry date;
b. cannot normally be exchanged for cash;
c. cannot be combined unless expressly permitted;
d. may be limited to specific products, customers or territories; and
e. may be cancelled where obtained or used fraudulently.
Promotions do not affect mandatory rights relating to defective, damaged, incorrect or misdescribed products.
1.10 Customer Accounts
You are responsible for maintaining the confidentiality of your account credentials and for activity carried out through your account.
Please notify us promptly if you believe your account or password has been used without authorisation. We may suspend an account where necessary to protect the customer, the Company or the Website.
1.11 Intellectual Property
The Website and its content—including text, photographs, product images, graphics, logos, designs, layout and software—are owned by or licensed to the Company and are protected by applicable intellectual-property laws.
Content may not be copied, reproduced, republished, sold, distributed or commercially exploited without our prior written permission.
1.12 Customer Reviews and Submitted Content
Where the Website allows reviews, photographs or other submissions, you must not submit content that is false, unlawful, defamatory, offensive, infringing, misleading or unrelated to the product.
You grant us a non-exclusive licence to display and use content you voluntarily submit for the operation and promotion of the Website, subject to applicable privacy law.
We may remove submitted content that violates these Terms.
1.13 Prohibited Uses
You must not:
a. use the Website for unlawful or fraudulent purposes;
b. interfere with the security or operation of the Website;
c. introduce malware, viruses or harmful code;
d. attempt unauthorised access to accounts or systems;
e. scrape or collect data without permission;
f. impersonate another person; or
g. use product photographs or Website content for unauthorised commercial activity.
1.14 Limitation of Liability
To the maximum extent permitted by applicable law, we are not responsible for indirect or consequential losses that were not reasonably foreseeable when the order was accepted.
We do not exclude or restrict liability where exclusion is prohibited by law, including liability arising from fraud, wilful misconduct, gross negligence or a breach of mandatory consumer rights.
1.15 Events Outside Our Control
We are not responsible for a delay or failure caused by circumstances reasonably outside our control, including severe weather, natural disasters, government restrictions, customs delays, transport disruption, labour disputes, payment-system failures, cyber incidents or interruption of utilities.
We will take reasonable steps to reduce the effect of such circumstances and keep affected customers informed.
1.16 Governing Law and Disputes
These Terms and all purchases made through the Website are governed by the laws of the United Arab Emirates and the applicable laws and regulations of the Emirate of Dubai.
The parties should first attempt to resolve any complaint directly and in good faith. If the matter cannot be resolved, the customer may approach the competent consumer-protection authority in Dubai or pursue any remedy available under applicable law.
Subject to mandatory consumer jurisdiction rules, the courts of Dubai shall have jurisdiction.
1.17 Language
These policies may be published in English and Arabic. If there is a conflict between the two versions, the Arabic version will prevail to the extent required or permitted by UAE law.
